Steps to Mediation
Many people aren’t familiar with divorce mediation. Mediation isa relatively new way to get divorced and still a less common method than divorce litigation. You do not need a divorce lawyer or a court referral from a judge to mediate your divorce. If you and your spouse agree, you can mediate and file for an uncontested divorce. In fact, the courts encourage this because it lessens the backload of divorce cases that need to be processed.
Do I Need a Divorce Lawyer or Divorce Mediator?
Divorce mediation does not need to involve divorce lawyers. A mediator can be a lawyer but does not represent either spouse’s interests.
Rather, the mediator acts as a neutral third-party to the divorce negotiations. The mediator helps the couple work through conflict so they can negotiate the terms and conditions of the divorce. Regardless if you get advice from a divorce lawyer during mediation, you may still want to have a lawyer review the separation agreement you and your spouse create before you sign it. A lawyer can make sure the outcome of the divorce will be in your best interests. This is a good fail-safe option if you are unsure you can make the right decisions during mediation. Finding a good mediator can also help ensure you have all the information you need to make the best decisions for you and your family.
