Risks in Divorce: Mediation vs. Litigation

Many people think the odds are stacked against them in divorce. They may start the process already on the defensive, ready to fight in court for what they want. Divorce litigation is full of risks. You take a risk when you hire an attorney to get you what you want through negotiations. If they don’t succeed, you are out the costs, plus a judge will end up deciding for you. Those mediating their divorce may take some risks as well, but mediation is relatively low-stakes when compared to litigation.

Your risks are quite significant in litigation, mostly because of the time, money, and confidentiality you invested into the process. Hiring an attorney to handle your divorce for you means you are entrusting this person with your future. Still, some people are left feeling like their attorney did nothing for them. If your mediator is experienced and you and your spouse are prepared, there are very few risks.
